AQW 47633/22-27 – Sharing of biometrics and criminal records data

Mr Patsy McGlone (Mid Ulster): To ask the Minister of Justice to detail any protocols in place regarding the sharing of biometrics and criminal records data with (i) the EU; and (ii) non-EU partners.

Minister of Justice: The reciprocal sharing of biometrics and criminal records data with EU Member States is provided for under Part 3 of the UK-EU Trade and Cooperation Agreement.

Where agreements exist with non-EU countries, the reciprocal sharing of biometrics and criminal records data can occur under the terms of bilateral agreements.

Where no such agreement is in place, sharing may be undertaken on a case-by-case basis.

In all circumstances, sharing can only take place in accordance with the conditions set out within the Data Protection Act 2018.
