Mr Patsy McGlone (Mid Ulster): To ask the Minister for Infrastructure, pursuant to AQW 46138/22-27, to detail (i) whether KPI one was achieved in each month, since commencement of Contract C1247 for Lots one and two; (ii) the total value of Service Credits (a) accrued; (b) applied; (c) recovered; (d) waived; and (e) otherwise, not recovered in respect of KPI one; (iii) the reason for any decision not to apply or recover Service Credits, otherwise available under the contract; and (iv) the mechanism by which Service Credits are recovered under Contract C1247, including whether such credits are deducted from invoices, set off against sums otherwise (a) due to Contractors; (b) recovered as debt; and (c) by any other means.
Minister for Infrastructure: The issue you have raised is an operational matter for NI Water; however, I have sought the required information.
NI Water has advised my department that:
KPI 1 was not achieved in each month since commencement of Contract C1247 for Lot one only.
(a) £1,800
(b) Currently the contractor has been issued communication indicating £1800 is due for performance in April 26.
(c) Not yet due for recovery.
(d) Not applicable.
(e) See (c) above.
Other than the initial period where there was relief on service credits, NI Water has exercised its right to recover all other service credits available, in accordance with the contract.
Service Credits are recovered through the issuance of a Credit Note from the contractor. During implementation, this mechanism was modified, with agreement from the contractors, that Service Credits would be extracted from amounts owing to the contractor by the client.
