Mr Patsy McGlone (Mid Ulster): To ask the Minister for Infrastructure, pursuant to AQW 48100/22-27, to detail (i) the date which the service credit recovery mechanism, under Contract C1247, was modified; (ii) the contractual clause under which that modification was made; (iii) the person who approved the modification; (iv) whether legal advice was obtained before implementation; (v) whether the modification constituted a formal contract variation; and (vi) whether the modification was published in accordance with Northern Ireland public procurement requirements.

NI Water has advised my department that:
The response to AQW 48100/22-27 referred to the Service Credit recovery mechanism being “modified” during implementation. However, for clarity, no amendment was made to the contract or specification in respect of the Service Credit provisions. During implementation, the parties agreed that Service Credits would be recovered by deducting the relevant amount from sums otherwise payable to the contractor. This reflected the agreed operation of the existing contractual arrangements and did not require a contract variation.
